Not sure if this is correct category but could someone help?


Had a credit card from local credit union. They put the wrong address on the statements and I didnt get any bills. They sold my loan/credit card to Bank of America. BOA gave this to Fredrick Hannah and associates in GA. I never got the opportunity to even pay this bill. Now Fredrick Hannah is calling me demanding $6,000 before the end of the year or I will go to jail. I am scared, hurt and upset at this. They even called my husband and told him I was running around on him. They told him that I had taken the card out with his name on it and was robbing him blind at his expense. What are my rights? How can I stop this non-sense? I pay my bills and would have paid this one if I had gotten an opportunity. Help please. (Please keep in mind, the credit union once upon a time did have my correct address. Someone somewhere screwed it all up and thats where the problem started.

Ok first off I'm going to be harsh. As a consumer it is your responsiblity to follow up with your creditors. If you stop receiving statements it is your responsibility to contact the creditor and ask what the situation is. Before the account was sold someone must have tried to call you. Did you receive any phone calls and ignore them?

You can not be thrown in jail for this. The collection agency can file for a judgement against you in court for you to pay. Have you personally talked with the creditor? Is there a way to negotiate the amount due? Ask for them to affirm your debt (be sure to make this request in writing!!!)

As far as your husband is involved, is his name on the account? If yes then they have every right to discuss the debt with him and they will be nasty about what they say. If he is not then it is against the law for them to discuss the account with him. If this is the case I would get an attorney immediately because they just broke the law and breached your privacy.

Collection agencies will say all sorts of things to scare you and to make you pay this debt. In future contacts with them I would document every conversation you have with them. Document date, time, name of person spoken to and what was discussed during the conversation. Make a copy of the document and mail a copy to the agency to be placed in your file. When mailing the copy mail it certified/return receipt requested. This will just further protect you.

Be glad they haven't called you at work. Those calls are really fun and embarrassing. If they do call you at work send a letter stating that they are not to contact you at work. The agency must comply with that written request (again mail it certified/return receipt requested and keep a copy.)

You can settle for less with most company's. As far as you going to jail. Not possible. All you need to do is fill out a Cease and Desist Letter and mail it or fax it to the collecttion company. They will no longer be able to call you. Go to the link I have provided. They have a sample letter for you to view.
