My camera was stolen from work,is the employer liable? |
I was asked to take pictures of co workers to be displayed on a board at work.I used my own equipment,and was in the middle of completeing the assignment when someone entered a secure area and stole my camera and cell phone.The employer is a large metropolitan hospital.Do i have a right to make a claim against the hospital at the risk of my employment? Should they be insured for such losses? What if any are my options or can i just kiss my camera good by and take the loss? I filed a local police report and a report with hospital security.Two months after the incident the hospital installed keyed access security in the building.A similar system was in place at the time of the theft but apparently didnt deter the thief. If you were asked to bring your camera to work as a direct part of your job, then the employer is responsible for articles stolen from a secure area. If you have presented this question to your employer and are not getting good answers, consult with an attorney. That is your best legal advice. But on the common sense side of things, do you really want to sue your employer? Depends on what your employers policy is. If in the contract that you signed or in the employees handbook that you were given it addressed this issue (schools forbid electronic items, cameras etc being brought on campus and it is stated in school handouts) and they are against it then they are not liable. My radio/recorder was stolen off my bus a few years ago, and my employer (the school system) never did a thing about it...Nor did the police...No options were avaliable for me, either... The law says that you are responsible for your own personal property. The only person accountable other than yourself is the theif. I believe not but you would think your boss would help you out. it probably had to be someone that works with u and sees everytig thats going on like thenew installment of the system and they'll feel guilty if not already. u can always think ur getting away with it and u really dont |
