My house i'm renting was sold! what can i do?!? |
i'm extremely upset. The duplex that i have been living in for 3 years was sold out from under me. we just re-signed a lease with our landlord in December and in March, a lady (who our landlord told us was an insurance lady) came to do a walkthrough of the house. last week, i got a letter from said 'insurance lady' telling me that she had bought our house and gave the address to mail our rent. Move out. YOu have no choice. Talk to a lawyer. move You might have a case if you were not given any notice, but you'll probably just have to move. Well your options are limited, either you can move or stay and pay you rent to the "insurace lady" The lease was most likely assigned to the new landlord. That is the common practice when a landlord sells a rental property. Do you like your place? You need to contact the landlord that you signed the lease with. For all you know, this "new landlord" could be yanking your chain, trying to get money out of you without the original landlord knowing anything about it. You do not owe money to someone without a written contract to say so. Do you have a tenancy tribunal in your area? They will be able to advise you. Well, even though you signed the lease with someone else the new owners are required to acknowledge and honor your previous contract. If you signed a leased with the previous owner, I thought you were under contract until the lease is over. I had a similar situation. Someone bought the house we were renting from and they just continuted to rent it out until it was over. Then when it was done they moved in and we moved out. I don't think they can change anything to the lease until a new term is set up. Does this make sense? I hope I'm giving the right info. I'm just going on experience. The lease is for you and the property that you are leasing and the lease transfers to the new owner. By not paying she can and most likely will take you to court and she will win no questions about it. She will be able to recover the monthly rent owed and for every month remaining on the lease plus attorney cost and the cost to collect the money from you and damages she says that you made to the property not to mention your deposits. It will go on your credit report that you skipped out on a lease and damage your credit and when she wins the court case (and she will) the judgment will go on your credit report as well. So you will end up paying and get bad credit out of this. When the house was sold the contract was most likely also "sold". Thats usually how it happens, at the closing any contracts between the owner and the tenants are released over to the new owner. You now owe her the rent. If you wish to move you must do so legaly. If you have been there for 3 years and like living there why not stay? Unless you just dont like this lady. Follow your contract and give her notice of you moving out as per your signed contract. If you do not follow the contract she has legal recourse against you. You can always contact an attorney or call the bar association. My mother and I both are real estate paralegals. Good Luck. if you wanted to move out you could because your contract is void due to the new owner because your contract specifies the old owner.now if you wanted to stay get in touch with the new owner. why do you have to move? did she tell you she wants you out? do you want to move? what difference does it make that you're paying rent to someone else who now owns your building as long as you're living in the same place? the terms of your contract won't have changed and the new owner knows of your contract with the old owner. you are still under the obligations stated in your contract i.e. to pay the rent, and if you don't pay the rent, then your new owner will be able to get the rent from the old owner because if her lawyer was clever, then there would be an indemnity clause in the contract between them. and then the old landlord might be able to claim said rent from you! place you live will have specific legal issues relating to leasing.
